Requirements for filing a trademark application in Saudi Arabia
- A power of attorney notarized and legalized up to the consulate of Saudi Arabia. One general power of attorney is sufficient for filing simultaneous and any future applications.
- The full name and address of the applicant.
- A list of the goods/services to be covered by the application.
- Fifteen prints of the trademark. A trademark print should not exceed 7x7 cm.
- Priority can be claimed if the applicant submits the following documents within six months from the date of filing of the application in the country of origin:
- A legalized declaration issued by the trademarks office of the priority application stating that it has reciprocal treatment with the Kingdom of Saudi Arabia in trademark matters.
- A certified and legalized copy of the home application, together with English translation. The legalized priority document should be submitted within six months from the filing date of the corresponding application, however, if the applicant is not in the position to provide us with the said document on time, then the application will be considered filed as a non-priority application.
The estimated time involved in obtaining the certificate of registration of a trademark will be around 7 months for a smooth application (without any objection or opposition).
Assignment Applications
- A power of attorney notarized and legalized up to the consulate of Saudi Arabia.
- A legalized deed of assignment executed by both assignor and assignee.
- The original Saudi registration certificate of the trademark for the purposes of endorsement.
Merger / License Applications
- A power of attorney notarized and legalized up to the consulate of Saudi Arabia.
- A legalized certificate of merger or a copy of the license agreement.
- The original Saudi registration certificate of the trademark for the purposes of endorsement.
Change of Name / Address Applications
- A legalized power of attorney showing the new name and/or address.
- A legalized certificate of change of name.
- The original Saudi registration certificate of the trademark for the purposes of endorsement. (As for recording change of address, only 1 and 3 of the above are required.)

1.

A legalized copy of the home registration
certificate of the trademark showing clearly the validity term of
the registration and the goods and /or services desired to
be registered.
3.
In the absence of home registration, a
legalized copy of any foreign registration of the trademark can be used
along with a certificate proving that the trademark is not registered in
the home country. The latter document, which should also be legalized
up to the Kuwaiti Consulate, can be in any one of the following forms:

A certified copy of the trademark
application in the home country.
5.
An official search report showing that the
trademark is not registered in the home country. A letter from the
Registrar of Trademarks in the home country addressed to the Registrar
of Trademarks in Kuwait to this effect will serve the purpose.
6.
A declaration executed by an officer of
the applicant company, sworn before a notary public, and stating that
the applicant company has no registration of the trademark in the home
country.
7.
Documents in other than English or Arabic should be accompanied with a sworn English translation.
8.
Twelve prints of the trademark for each
class (preferably not exceeding 5x5 centimeters each). Additional
publication charges are to be paid for a large size print. The prints
can be prepared locally upon request. The prints should be in exact
conformity with the form of the mark shown on the basic certificate
of registration. |

In the other countries, the documents should be submitted simultaneously with the applications.
