  • Requirements for filing a trademark application in Saudi Arabia

    1. A power of attorney notarized and legalized up to the consulate of Saudi Arabia. One general power of attorney is sufficient for filing simultaneous and any future applications.
    2. The full name and address of the applicant.
    3. A list of the goods/services to be covered by the application.
    4. Fifteen prints of the trademark. A trademark print should not exceed 7x7 cm.
    5. Priority can be claimed if the applicant submits the following documents within six months from the date of filing of the application in the country of origin:
      1. A legalized declaration issued by the trademarks office of the priority application stating that it has reciprocal treatment with the Kingdom of Saudi Arabia in trademark matters.
      2. A certified and legalized copy of the home application, together with English translation. The legalized priority document should be submitted within six months from the filing date of the corresponding application, however, if the applicant is not in the position to provide us with the said document on time, then the application will be considered filed as a non-priority application.

    The estimated time involved in obtaining the certificate of registration of a trademark will be around 7 months for a smooth application (without any objection or opposition).

  • Assignment Applications

    1. A power of attorney notarized and legalized up to the consulate of Saudi Arabia.
    2. A legalized deed of assignment executed by both assignor and assignee.
    3. The original Saudi registration certificate of the trademark for the purposes of endorsement.
  • Merger / License Applications

    1. A power of attorney notarized and legalized up to the consulate of Saudi Arabia.
    2. A legalized certificate of merger or a copy of the license agreement.
    3. The original Saudi registration certificate of the trademark for the purposes of endorsement.
  • Change of Name / Address Applications

    1. A legalized power of attorney showing the new name and/or address.
    2. A legalized certificate of change of name.
    3. The original Saudi registration certificate of the trademark for the purposes of endorsement. (As for recording change of address, only 1 and 3 of the above are required.)

  • Requirement for filing trademark application in GCC and Arab World

    Filing Requirements in Bahrain 

    A

    Trademark/ Service Mark Applications.

    1. A certified copy of the home registration or any foreign registration of the trademark    (except from boycotted countries). 

    2. A power of attorney simply signed attached.

    Kindly be advised that it not now permitted under the Bahraini Trademark Law to file any trademark applications without submitting the complete documents at the time of filing.

    B

    Renewal of Trademark / Service Mark Registrations

    1. A simply signed power of attorney.

    2. The number and date of registered trademark/service mark.

    Filing Requirements in Kuwait 

    A

    Trademark/ Service mark Application

    1.       A power of attorney legalized up to the Consulate of Kuwait attached.

    2.       A legalized copy of the home registration certificate of the trademark showing clearly the validity     term of the registration and the goods and /or services desired to be registered.

    3.       In the absence of home registration, a legalized copy of any foreign registration of the trademark can be used along with a certificate proving that the trademark is not registered in the home country.  The latter document, which should also be legalized up to the Kuwaiti Consulate, can be in any one of the following forms:

    4.       A certified copy of the trademark application in the home country.

    5.       An official search report showing that the trademark is not registered in the home country. A letter from the Registrar of Trademarks in the home country addressed to the Registrar of Trademarks in Kuwait to this effect will serve the purpose.

    6.       A declaration executed by an officer of the applicant company, sworn before a notary public, and stating that the applicant company has no registration of the trademark in the home country.

    7.       Documents in other than English or Arabic should be accompanied with a sworn English translation.

    8.      Twelve prints of the trademark for each class (preferably not exceeding 5x5 centimeters each). Additional publication charges are to be paid for a large size print. The prints can be prepared locally upon request. The prints should be in exact conformity with the  form of the mark shown on the basic certificate of registration.

    B

    Renewal Applications

    1. A power of attorney notarized and legalized up to the Consulate of Kuwait.

    2. The original Kuwaiti registration certificate of the trademark for endorsement purposes.

    Filing Requirements in Oman

    A

    1. A power of attorney duly legalized up to the Consulate of Oman attached.

    2. A certified copy of the certificate of incorporation of the applicant company, an extract of its entry in the commercial register or a good standing certificate including all relevant information.

    3. Prints of the trademark.

    B

    Renewal of trademark registrations.

    1. A power of attorney duly legalized up to the Consulate of Oman.

    2. If none is available then trademark number and class.

    2. A copy of the certificate of incorporation of the applicant company or an extract of the entry of the applicant in the commercial register duly legalized up to the Consulate of Qatar.

    4. The list of the goods to be covered by the application

    5. The name, address and nationality of the applicant and the nature of its business.

    6. A certified copy of the priority document if it is claimed.

    B

    Renewal of trademark registrations.

    1. A simply signed power of attorney.

    2. The name, address and nationality of the applicant and the nature of its business.

    3. The trademark number.

    A

    Trademark/service Mark Applications.

    1. A power of attorney duly legalized up to the Consulate of the United Arab Emirates.

    2. Eighteen self-adhesive prints of the trademark/service mark.

    3. A certified and legalized copy of the home/foreign application/registration, if priority is claimed.

    B

    Renewal Application

    1. A power of attorney duly legalized up to the Consulate of the United Arab Emirates.

    2. The original certificate of registration of the trademark for endorsement purposes.

    Filing Requirements in Jordan

     

    A

    Trademark/service Mark Applications.

    1. A power of attorney duly Notarized & legalized up to the Jordanian consulate. (Application can be filed with the power of attorney provided that legalized original will follow within one month as from the filing date).

    2. Eighteen self-adhesive prints of the trademark/service mark.

    B

    Renewal Application

    1. A power of attorney duly legalized up to the Consulate of Jordan.

    2. The original certificate of registration of the trademark for endorsement purposes.

    Algeria: The documents and other requirements needed for filing trademark applications are as follows

     

    1.

    Fifteen self-adhesive prints of the trademark and a printing block (not exceeding 9 cm)

    The registration number and filing date in the home country (if available)

    Egypt: The documents and other requirements needed for filing trademark applications are as follows

    A. power of attorney legalized up to the Egyptian consulate

      1.  Name, nationality, address, occupation, and nature of business of the applicant company

    Iraq: The documents and other requirements needed for filing trademark applications are as follows

     

    1

     1.  A power of attorney including the eight-point boycott questionnaire duly legalized up to the consulate of Iraq.

     

    2

    The name, address, nationality, and occupation of the applicant.

     

    3

     2.  The classes and subclasses of the goods to be covered by the application.  The wording of list of goods to be protected  must conform to the local classification, which is similar to the International Classification.

     

    4

     3.  Ten prints of the trademark; a local requirement stipulated the Arabic transliteration should be shown above the Latin script.

    Lebanon: The documents and other requirements needed for filing trademark applications are as follows

     

     

     1.  A power of attorney simply signed

     

     

    The registration numbers and dates (if the trademark is registered outside Lebanon preferably of the home country). A copy of the home certificate of registration or application is required only for claiming convention priority provided it is filed within two months of he filing date.

     

     

     2.  Five prints of the mark.

    Libya: The documents and other requirements needed for filing trademark applications are as follows

    A power of attorney legalized up to the Libyan consulate

    A printing block and ten prints of the trademark ( not needed for word mark )

     

    3.

    A legalized extract of the entry of the applicant in the commercial register or a legalized copy of the certificate of incorporation if the applicant is a company or a body corporate.

    Morocco: The documents and other requirements needed for filing trademark applications are as follows

     

    1

    A simply signed power of attorney.

     

    2

    A certified copy of the basic registration if convention priority is to be claimed.

    West Bank: The documents and other requirements needed for filing trademark applications                      in West Bank are as follows:

     

    1.

    A power of attorney legalized up to the Palestinian Consulate. Notarization is acceptable if a Palestinian Consulate is not available.

     

    2.

    Name, nationality, address, occupation, and nature of business of the applicant company

     

    3.

    5 prints of the mark

     

    4.

    A copy of the certificate of incorporation or an extract of entry of the applicant company.

    Gaza Strip: The documents and other requirements needed for filing trademark applications                      in Gaza Strip are as follows:

    A power of attorney simply signed on behalf of the applicant company

    Name, nationality, address, occupation, and nature of business of the applicant company

    Sudan: The documents and other requirements needed for filing trademark applications are as follows

    A power of attorney simply signed.

    A certified extract of the entry of the applicant company in the commercial register, or a certified copy of the certificate of incorporation legalized up to the Sudanese Consulate. If not in English or Arabic., a certified and legalized translation of the extract in either language should be provided, legalized up to the Sudanese Consulate

    A power of attorney simply signed and stamped with the corporate seal or rubber stamp of the applicant company for each application

    A certified copy of the home registration of the trademark. In the absence of a home registration, the registrar in Syria may accept a certified copy of any foreign registration of the trademark

    A legalized copy of the certificate of incorporation or an extract of the commercial register which should include the name, address, date of incorporation and objectives of the corporation.

    Iran: The documents and other requirements needed for filing trademark applications are as follows

     

    1

    A power of attorney legalized up to the Iranian consulate.

     

    2

    A printing block and twenty prints of the trademark.

    The list of goods and the classes pertaining thereto.

    A simply signed statement of ownership.

     

    5

    A certified copy of the home or foreign registration certificate.

     

    It is noteworthy that we can proceed with the filing of trademark applications and obtain priority filing numbers and dates in Qatar, Oman, Jordan, Tunisia, Morocco, Libya, Lebanon, and Algeria upon receiving your instructions and the filing data, (name, address and nationality of the applicant company and the list of goods or services to be covered by the application) whereas the documents needed can be submitted at a later stage. In the other countries, the documents should be submitted simultaneously with the applications.
